And be it further enacted by the Authority aforefaid, That the Ferry-men, Ferry-men or Tenders of the Ferries at New-London, Say-Brook, New-Haven Lower- to give good Attendance, Ferry, Hartford, Stratford, and all other Ferries in this State, where two and not fufBoats are by Act of the General Affembly required to be kept, fhall carefully fer both and diligently attend to the conveniency of Paffengers: And to that End they boats to be hall not fuffer both the Boats to lie at the fame Time on one Side of the Fer- one fide at ry; but as foon as one Boat has croffed fuch Ferry, the other Boat fhall immedi- the fame ately put off and go to the other Side, whether there be any Paffengers ready to go over or not, unless the other Boat fhall immediately return. Fees, and Penalties.

BE it enadied by the Governor, Council, and Reprefentatives, in General Court

And all fuch Fines, Forfeitures, and Penalties as fhall by the Judgment of any Affiftant, or Juftice of the Peace, be impofed on any Perfon or Perions for any Matter of Delinquency, fhall be and belong to the Treasury of the Town where fuch Judgment is given.

Always provided, That where any fuch Fines, Forfeitures, or Penalties are or fhall be otherwife ordered by any exprefs Law of the State, they fhall be dif posed of according to the Order of fuch Law; any Thing before in this Act to the contrary notwithstanding.

An Act for encouraging and regulating Fisheries.

BE it enacted by the Governor, Council and Representatives, in General Court

Spring, or proper Seasons of the Year, is disturbed or prevented; on Conviction thereof before the County Court, fhall pay a Fine of Ten Pounds, to any Perfon who fhall fue for, and profecute the fame to Effect; and the faid Court may order fuch Obftraction to be removed at the Colt of the Perfon or Perfons who erected the fame. And the fame fhall be deemed a common Nufance, and any Person may remove the fame as fuch."

Provided, That no Perfon fhall remove any Mill-Dam, until the fame hath Provifo. been adjudged to be a Nufance, and ordered to be removed by the Superior or County Court.

And whereas the continual Interruption of the Courfe and Paffage of the Filh up the Rivers, by the daily drawing of Seins and other Fish-Craft, tends to prévent their Increase, and occafions a great mifpence of Time, and also prevents the People who live near the different Parts of Juch Rivers from baring the Benefits of the Fifberies, jo equally as they might otherwife dó: To the injury of the Public.

Be it further enalted by the Authority aforefaid, That no Perfon or Perfons No feins, Ci fhall draw any Sein or other Fish-Craft, in any of the Rivers before mentioned to be drawn, in this A&t, except between the fetting of the Sun on Monday Evening, and except, &c. the Sun's rifing on Saturday Morning, in each Week in the Months of April, May and June, annually, on Penalty of forfeiting Ten Pounds, for the ufe of him who fhail fue for, and prosecute the fame to Effect,

Levenworth's-Ferry, and have conftantly ufed the fame for taking Fish in the

Enjoyment thereof, fo fong as they continue conftantly to use the fame, in the
Seasons, and for the Purposes aforefaid, and not be liable to any Action for Da-
mage, below high-water Mark.

Be it enacted by the Authority aforejaid, That no Perfon fhall, fet or draw any Sein for the purpose of catching Fish, between the fifteenth Day of March, and Set times for the fifteenth Day of June, in any Year, South of an East and Weft fishing, &c. Line from Say-Brook-Fort, fo called, within one Mile and an Half

Forceable Entry.

Coves called and known by the Name of Lynde's-Cove, and Gripwold's-Cove, and except the Proprietors of the Lands on each Side of faid River, known by the Name of Eaftern-Point, and Lynde's-Point, who fhall have exclufive Right to draw or ufe two Seins, at Discretion, within the aforefaid Limits, in the Waters, adjoining their own Lands, from Monday Morning at Sun-rife until Sunfet on Friday Evening, in each Week, and no more; and neither of faid Seins fhall be of greater Length than Twenty-five Rods. And every Person that shall be convicted of any Breach of this Paragraph of this Act, fhall pay a Fine of Ten Pounds; one Half to the Profecutor, and the other Half to the Treafury - of the County; and fhall also forfeit the Sein, Ropes and other Utenfils used for catching Fish contrary to this A&t.

That whoever shall first make a Ware for catching Fish on any Flats, of or within any River, Cove, Creek or Harbour within this State, fhall not be Perfons first interrupted by any, other's fetting or making a Ware on the fame Flat; or in making the Way or Courfe of the Fish coming or paffing to the faid Ware first built, wares on nearer than three-quarters of a Mile; without Liberty from the County Court; flats, not to and the Ware fo fet up contrary to this Act, shall be a common Nufance, and be interrupted, &c. any Perfon may remove the fame as fuch.

Selden's

Informing

That no Perfon fhall fet or draw any Sein, or otherwife obftruct the Courfe of the Fish, into or up Selden's-Creek in Lyme, within forty Rods eastward of the Mouth of faid Creek, on the Great River, or within fixty Rods within faid Creek, or at any Place below the Homock, on Penalty of forfeiting Ten Pounds to the Profecutor. Provided nevertheless, That the Proprietors of the Homock may at all Seasons fish at that Place; and the Proprietors of Land adjoining faid Creek below the Homock, not within fixty Rods of the Mouth of the Creek, may fish on their own Lands upon the tide of Ebb only, after the eighteenth Day of May annually.

And it fhall be the Duty of the Informing Officers to enquire, and prefent to lawful Authority, all Breaches of this Act; and in that Case the Penalties fhall prefent, &c. belong to the Treasury of the County where the Conviction is had.

An Act directing Proceedings against forceable Entry and
Detainer.

BE

E it enacted by the Governor, Council and Representatives, in General Court affembled, and by the Authority of the jame, That upon Complaint made to any One or more Affiftants or Juftices of the Peace, of any forceable Entry made into any Houfe, Lands, Tenements, or other Poffeffions lying within the County where fuch Affiftant or Affiftants, Justice or Justices dwell or reside; or of any wrongful Detainer of any fuch Houle, Lands, Tenements, or other Poffeffions by Force and strong Hand: That is to fay, by, or with fuch violent Words or Actions as have a natural Tendency to affright and terrify: Every fuch Affiftant or Affiftants, Justice or Juftices within convenient Time, at the Coft of the Party grieved, fhall go to the Place where the faid Force is; taking with him or them the Sheriff of the County, or his Deputy, and other fufficient Power of the Town, or County, (if need be) to aid and affist said Authority: And all the People of the County, as well the Sheriff as others fhall be attending the said Affiftant or Affiftants, Juftice or Juftices to affift him or them to arreft fuch Offenders, when thereunto called, upon Pain of Imprisonment, and of paying a Fine of Twenty Shillings, to the Treafury of the County..

And that two Affiftants or two Juftices, Quorum Unus, or one Affiftant and one Justice, shall have Authority to enquire, by the Oaths of the People of the fame County, as well of them that make fuch forceable Entry into Houses, Lands, Tenements or other Poffeffions; as of them who hold and detain the fame by Force and ftrong Hand.
