It is bereby Enacted by the Authority aforesaid, That the faid Comptroller To inflitute fhall be fully Authorized and Impowered to Inftitute Suits at Law in the Name of this State against any and every Perfon or Perfons, or Body of Men who have received any public Monies, or Property by any way or means whatsoe... ver, and who have not regularly accounted for the fame, (excepting only the Collectors of the public Taxes in the State.) And for this purpose the faid Comptroller is Authorized to Employ, or Subftitute an Attorney, or Attornies under him, tofue for fuch Monies, or other Property fo unaccounted for, and pur fue the fame to final Judgment and Execution in favour of this State. And that the Officer who shall Collect, the Monies on fuch Execution, and all other Perfons who shall by the appointment, Order, or direction of fuch Comptroller, receive the Monies of this State fhall pay the fame (when Collected) to the Treafurer of this State taking Duplicate Receipts therefor, and Lodge one of them with the Secretary, and the other with the Comptroller: And it shall be the Duty of the faid Comptroller to exhibit to the General Aflembly in May and October annually, (and oftener if thereto required) an Account of all monies received. into the Treafury, on any, and all Taxes that have been laid and are yet unfettled, or may from Time to Time be laid, and Affeffed by the General Affembly, together with the deficiencies and Abatements made on fuch Taxes: Also an Account of all Monies that may be received into the Treasury for Fines, Forfeitures, Penalties, and Confif ations, or by any way, or means whatever, together with an Account of all Debts due to this State, and from whom.

And also a General or particular Statement of the Appropriation of the Monies received in as aforefaid, and in tuch manner as he may judge moft Expedient to fhew their real Situation, or according to fuch directions or Order as he may Receive from the General Affembly or (in their Recefs) from the Governor.

And fuch Comptroller fhall have the General Superintendance of all Matters that respect the Subject of Finance, and shall advife as to the mode of keeping, Stating, adjufting and liquidating the public Accounts of this State, fubject to the Controul and Order of the General Affembly, and fhall take fuitable Care that the regular and neceffary Checks in the Mode of keeping Accounts be initituted and maintained. And if any further Regulations may in his OpiNew regula- nion be neceffary to compleat the Syftem of his Department, to lay the fame before the General Assembly as often as he may think proper, and all Plans, and Calculations formed for the purpofe of leffening the public Expences, and for uling and improving the public Monies to the beft Advantage, and that may ferve to the furtherance and promotion of Frugality and Oeconomy in the public Expenditures, or that may have a tendency to eftablish and fupport the public Credit of this State by proper Funds, or otherwife, or that may in any Refpect have Relation to the well Ordering and Regulating the Bufinefs of his Department and Office, fhall be laid before the Legiflature of this State for their Confideration by fuch Comptroller at the opening of every stated Sefkon of Affembly.

An Act for Erecting and Establishing a New County.

Bit Towad E it enaded by the Governor, Council and Representatives, in General Court Towns in affembled, and by the Authority of the fame, That the Towns of Tolland, Tolland Coventry, Hebron, Bolton, Somers, Stafford, Willington, Union, and the County. Parish of Ellington in Eaft Windfor be, and they are hereby constituted a County by the Name of the County of Tolland.

And be it further Enacted, That there fhall be annually holden in faid County two Courts of common Pleas, or County Courts, one on the third Tuesday Time of of March, and the other on the third Tuefday of September in faid Tolland, holding and alfo one Superior Court fhall be holden in faid Tolland in and for faid Tolland County on the laft Tuesday fave one of January Annually. And all Caufes County. already Inflituted in the Counties of Hartford, and Windham in favour of, or against any Person or Perfons in either of faid Towns fhall proceed to final Judgment, and Execution, and all Writs of Execution already Iffued, fhall be proceeded on as though this A& had not been made.

An Act in further addition to, and explanation of an Act enti-
tuled " an Act for collecting, and paying Rates, or Taxes."

HEREAS by faid Act, it is Enacted, that all the Real Estate
that any one is feized of and poffeffed of in his own Right in fee with-
in this State, shall be liable to stand chargeable with all the public Taxes dec
from the owner thereof, and shall Remain as a Lien thereon until the same are
fully paid, notwithstanding any fubfequent Sale, or transfer thereof, or any
Attachment thereon; And whereas by the Provifions of faid A&t for the Re-
demption of any fuch Eftate, fome Doubts have arisen whether any other Per-
fon has a Right to redeem Estate fold agreeable to faid A&t for the payment of
Taxes than the Proprietor, or Proprietors for whofe Taxes faid Eftate was fold,
which Doubts to Remove.

ESOLVED by this Assembly, That the Intent, and meaning offaid A&t is, that any Proprietor, whether original, oran after Purchaser, or any Creditor Attaching fuch Eftate, or their Heirs, may at any Time within the Time limited, Redeem faid Estate, by paying the principal fum for which fach Sale is made, and double Intereft thereon, in the fame Monies and Securities due on the Taxes for which the Sale was made, and all Cott arifing thereon.

And it is bereby further Enacted by the Governor, Council, and Representatives in General Court Affembled, and by the Authority of the fame, That for the fu. ture it fhall and may be lawful for any Creditor, or Creditors to any Perfon whose Real Estate has been fold for Taxes, agreeable to faid former Act, and not redeemed within the Time limited (By faid Proprietor, or Proprietors, or their Heirs or Representatives or other Perfon attaching, previous to the Sale made for faid Taxes) may Redeem the fame in the fame manner, as is provid ed for the Proprietor or Proprietors, on whofe account fuch Sale was made, and shall hold the fame as a Lien for fecurity in Nature of a Mortgage, for fo much as he shall advance for the Redemption thereof, and which fhall be first paid out of the Avails of said Estate before any other Demand whatsoever.

And it is bereby further Enacted by the Authority aforesaid, That where any Creditor to the real Owner, or Owners of fuch Eftate in Order to Clear the fame from the Taxes, fhall advance and pay the public demands thereon, whether before the Sale of fuch Eftate at Auction, or after, shall be paid out of the Avails of fuch Eftate, or otherwife, the full Value of the Monies, or whatever else he has so advanced, and double Intereft thereon, before said Estate shall be cleared of that Incumbrance.

E it enacted by the Governor, Council, and Representatives, in General Court affembled, and by the Authority of the jame, That the feveral Judges of Probate under whofe Adminiftration, or within whofe Diftricts, any Lands be longing to this State are now unfold, may, and they are hereby Authorized and impowered to give Orders for the difpofal of fuch Lands at private Sale, in the whole, or by parts, or at public Vendue, at discretion, as thall be found moft Convenient, and beneficial for the State.

And faid Judges of Probate refpectively, are hereby Authorized and im powered in behalf of this State, to make and Execute Deeds of Conveyance,

ith Warranty, of fuch Lands in due form of Law, and the fame shall be good, to execute Authentic, and legal Evidence of Title of fuch Lands to the Grantees, in the Deeds. everal Courts of Law in this State.

And all fuch Land already agreed to be fold by order of Law, and Deeds ot yet given, may be confirmed to the purchasers by Deeds Executed by the espective Judges of Probate as by this Act is provided. And faid Judges of Probate fhall receive payment for all fuch Lands in Specie, or Liquidated Securities of this State for lawful Money, on Intereft, and fhall Render an Account thereof to the Treasurer of this State within one Year from the Time of fuch Sale.

The Lands in New-Haven, New-London and Groton, appropriated for Building Forts, &c. for defence of this State, to be referved for that Ufe, any Hing in this A&t notwithstanding.

An Act in addition to a Law of this State Entitled "An Act for collecting and paying Rates or Taxes."

WHEREAS various Opinions, and practices have been adopted, relative to what Fees might lawfully be received, by Sheriffs charged with Executing Diftreffes, or Warrants fued by the Treasurer for collecting Taxes due to the State, And Whereas it is neceffary that the Law be made Clear, and Definite in bis refped, and that adequate provifion be at the jame Time made to pay jaid Offi cers charged with the aforesaid Collections.

BE E it therefore Enacted by the Governor, Council, and Representatives in General Court Affembled and by the Authority of the fame; That the fame on Treasurer's Mileage shall be allowed the Sheriffs for Executing laid Diftreffes, or Warrants warrants; Iffued by the Treasurer of the State, as is by Law allowed to Sheriffs for Writs for collecting; of Summons, or Attachment; and that faid Sheriffs be allowed to collect of the Perfon, or Perfons against whom any fuch Diftrefs, or Warrant fhall Iffue, one fhilling on the Pound, for the firft Pound, and three pence on the Pound for every subsequent Pound, which he fhall really and truly Collect for the Use of the State; which Fees fhall be payable in Specie, or Bills of Public Credit, or public Securities in the proportion, and as the fame is demanded by fuch Warrant, not counting Fees on any Sum which may be paid to the Treasurer by any Perfon, or Perfons against whom faid Warrant or Execution Iffued.

That whenever any Sheriff fhall Commit any Perfon, or Perfons to Prison, by Virtue of fuch Warrant, he fhall be allowed befides his faid Mileage, the for commiting fame Cofts for his Affiftance as is by Law allowed for Executing Writs of Exeto prifon. cution, and shall also be allowed upon any fuch Commitment, and for a Copy of his Distress, or Warrant, fix shillings on every fuch Warrant not exceeding

One hundred Pounds, and fix fhillings on every fubfequent Hundred Poundi contained in such Warrant, and which fhall appear to be due at the Time of Commitment, payable in Specie, or Bills of Public Credit, or in the public Securities, according to, and in the proportion which shall be demanded by fuch Warrant, and which Fee, and Cofts shall be diftinctly Charged by faid Sheriffe en every Warrant which they shall Return to the Treasurer.

And in Cafe of a Return of Non eft laventus on any fuch Diftrefs and Warrant the Sheriffs fhall be Entitled to Mileage or Travelling Fees only.

That the Treasurer of the State whenever he shall fue an Alias Distress a Former fees Warrant in Confequence of fuch Commitment, fhall infert under the Title of Cofts the amount of fuch Fees, and Cofts lawfully charged, and when it shall be neceffary, Reduce the fame to Specie at the Current Exchange at the Time when fuch Alias Warrant fhall Iffue, and faid Treasurer fhall alfo proceed in the fame manner in fettling the Fees and Cofts upon the Returns of all fuch Warrants in his Office, upon which no Alias Diftrefs or Warrant has been Ifflued.

E it enacted by the Governor, Council and Representatives in General Court affembled, and by the Authority of the fame, That the meetings of the Freemen in the feveral Towns in the County of Tolland for the purposes mentioned in faid Act, fhall be on the firft Monday after the firft Tuesday of April, and en the fecond Tuesday of September annually.

An Act in addition to, and alteration of the Statute Law, for laying an Excife on fundry Articles of Confumption within this State.

Bε it E it enacted by the Governor, Council and Representatives in General Court affembled, and by the Authority of the fame, That all fuch Retailers, and Retailers, &c. Confumers of any Goods, Wares, and Merchandize which by faid A, or by any Law of this State, are or fhall be subjected to the payment of Excife as have not kept a particular Account of fuch Articles as aforefaid, as they have fold by Retail, or confumed fince the first Day of January 1785, fhall when tequired by the Collector, or his Deputy, or within Eight Days afterwards, and be 'fore the firft Day of September next, Exhibit to fuch Collector or his Deputy a true Manifest in writing under the Oath of fuch Retailer, or Confumer, of all fuch Goods, Wares, and Merchandize by Law fubject to Excife, as hé, or they have fold by Retail, or Confumed fince the first Day of January A. D. 1785, and until the Time of rendering fuch Manifeft on which the Excife hath not been paid according to his, or their belt Knowledge, and Judgments and fhall pay the Excife thereon as the Law Requires.
