And the Form of the Oath to be taken by the Common Council-Men of faid City, fhall be as follows, viz.

You being eleaed a Common Council-Man for the City of Norwich, for the Year enfuing do fwear by the Name of the ever-living God, that you will faithfully and uprightly difcharge the Duties of that Office fo long as you shall bold the jami. So help you God.

And the Form of the Oath to be taken by the Sheriffs of faid City, fhall be mke an oath. the fame prefcribed by Law to be taken by the Sheriffs, mutatis mutandis. And the Form of the Oath to be taken by the Clerks of faid City, fhall be as follows, viz.

You being chofen Clerk of the City of Norwich, do fawear by the Name of the ever-living God, that you will truly and faithfully attend and execute the Place and Office of Clerk of Jaid City, according to your b.ft Skill, and make true Entries and Records of all the Votes and Proceedings of jaid City, and juch other Matters as by Law or by the Bye-Laws of laid City, are to be recorded in your Office, and that you will deliver true Copies of the Records in your Hands, when they shall be required of you, taking only your lawful Fees. So help you God.

Which Oaths may be administered by any Affiftant of this State, or Juftice of administered, the Peace within and for the County of New-London, or by the Mayor or either of the Aldermen of faid City, provided the Mayor or Alderman adminiftering fuch Oath hath been fworn according to this Act.

And the Perfon adminiftering the Oath prescribed by this A&, fhall give a Certificate thereof under his Hand to the Officer to whom he administered fuch Certificates to Oath, which Certificate shall be recorded in the Records of faid City, before be given and the Perfon to whom it is given shall be capable of executing the Office to which he was cholen,

contrary notwithstanding; and fuch Records may be made by Clerk hereafter chofen of their being chofen and fworn, and fhall be good and effectual, any thing in this Act to the contrary notwithstanding; and faid City fhall thereupon proceed to chufe a Mayor and the other Officer of faid City eligible by the Freemen thereof; and the Juftices of the Peace within and for the County of New-London, living and inhabiting within the Limits of faid City and prefent at fuch first Meeting, fhall have as to the Election of the Mayor, Aldermen, Sheriffs, Common Councilmen and Clerk of faid City, the fame Powers and proceed in the fame Manner as the Mayor, Aldermen and Sheriffs of faid City by this Act are to have and proceed in at the future Elections of faid City. And the fenior Juftice of the Peace within and for the County of New London living within the Limits" of faid City, prefent at faid firft Meeting; fhall be Moderator thereof, until there fhall be a Mayor or Alderman chofen and qualified according to this Act; and faid City hall at their first Meeting appoint a Time and Place for holding the firft Court of Common Council, which Court shall have Power to adjourn from Time to Time; and the first City Courtof faid City shall be holden on the fecond Tuefday of Auguft next at the Town-Houfe in faid City, and the City Courts of faid City may be holden in faid Town-Houfe from Time to Time, or in fuck other Place in faid City, as faid City thall provide and judge proper.

Always provided, That any Thing in this A&t notwithstanding the Inhabi tants living within the Limits of faid City fhall to all Intents and Purposes be and remain a Part of the faid Town of Norwich.

Provided nevertheless, That if this Act or any of the Provifions thereis contained fhall be found inconvenient, or in any Respect inadequate, the fame on Reprefentation of the city or otherwife may be altered or revoked by the General Affembly.

Provided nevertheless, That the Judges of faid city coat may and they are hereby authorised to hear, try and finally determine all cauíes brought before the city court by a Jury of fix Freemen, or without a Jury, where neither of the Parties defire to have a caufe decided by a Jury, or by more than fix Jurors. And this A&t fhall to all Intents and Purposes be a public Act.

An Act for levying and collecting Duties on the Importation of certain Articles, and for appropriating the fame.

B E it enacted by the Governor, Council and Representatives, in General Court affembled, and by the Authority of the fame, That from and after the fict Day of January next, there fhall be paid on the following Articles, imported or Duty of two brought into this State, by Land or Water, not the Manufacture of any of the per cent. on United States, viz On the following Articles, in Addition to the Duties here- certain enus tofore laid, viz. On all wrought Silk, Gauze, Muflin, Cambrick, Lawn, merated are Chintz, Lace, and Linens, a Duty of two per Cent. ad Valorem, at the Time and Place of Importation, said Value to be ascertained, and faid Duty to be collected in the fame Manner, and under the fame Regulations, Forfeitures and Disabilities, as are provided in and by a Law of this State, intitled, An Act for levying and collecting a Duty on certain Articles of Goods, Wares and Merchandize, imported into this State by Land or Water;" on each Beaver Particelar and Beaveret Hat, Six Shillings; on each Caftor Hat, Three Shillings; on each duties on cer Felt Hat, One Shilling; on each Pair of Men's or Women's Shoes, One Shilling; tain articles,* on each Pair of Boots, Six Shillings; on each Pound of tanned Leather, Threepence; on each Saddle, Ten Shillings; on all Cheefe, not the Manufacture of any of the United States, Four-pence per Pound; on each Pound of Sugar, other than brown Sugar, whether the Produce or Manufacture of the United States, or not, imported into this State, Three-pence; to be collected in the fame Manner, and under the fame Regulations, Forfeitures, Penalties, and Disabilities, as the Duties of two per Cent. on the Articles before enumerated in this Act.

And be it farther enacted by the Authority aforefaid, That a Duty of Threepence per Gallon be laid and collected on all Wines, and on all Brandy, Geneva, and other distilled fpirituous Liquors, (except Rum) which fhall be imported Duty on into this State by Land or Water, and a Duty of Three-pence per Gallon on all Beer, not made in the United States, to be collected in the fame Manner, and under the fame Regulations, Forfeitures and Penalties, as the Duty on Rum, by Virtue of a Law of this State, intitled, "An Act for laying and collecting Duties on the Importation of Rum."

And be it further enacted, That the Monies arifing on the Duties aforesaid, be, and they are hereby appropriated for pa ing this State's Quota of the Inter- Duties how eft of the Debt of the United States, agreeably to the Requifitions of Congrels, appropriated and the fame may be paid in Money, or Certificates for faid Intereft, to be iffued from the Loan-Office in this State, purluant to a Refolution of Congress,

And be it furiber Enacted, That there fhall be a further Duty of One Penny

per Gallon on all Rom imported into this State, in Addition to the Duty of Additional Two-Pence on the Gallon, granted by the aforesaid Act, intitled, An A&f duty of one laving and collecting Daties on the Importation of Rm," and fhall be collect deny on in the fame Manner as in faid Act is provided.

This Act to commence on the firft Day of January next, and be in Force from and after that Time.

An Act in Addition to an Act, intitled, An A&t, for encourag ing and promoting the Commerce of this State.

B

E it enacted by the Governor, Council, and Reprefentatives, in General Court affembled, and by the Authority of the jame, That all Barrels used for the packing of Beef or Pork, containing twenty-eight Gallons, and two Hundred Weight, and every Barrel ufed for packing of Fish, and containing twenty-eight Gallons, fhall be deemed to be merchantable, and of full Affize, any Law, Ufage, or Cuftom, to the contrary notwithstanding.

That all barrelled or falted Fifh for Sale, (except fuch as are fplit) fhall be packed and put up edgewife; and whofoever shall fell, or fhip for Sale, any fuck barrelled or falted Fish otherwife packed (excepting as aforefaid) fhall forfeit and pay the Sum of Twelve Shillings for every fuch Barrel of falted Fish, and fo in Proportion, when the fame are falted or packed in greater or lesser Casks; to be recovered by any one who fhall fue for the fame.

That the Dimenfions of the several Sorts and Kinds of Lumber for Exporta tion, hereafter mentioned, fhall be as follows, to wit,---All White-oak Pipe Staves, four Feet eight Inches long, and three Inches and an Half in Width; White-oak Hogshead Staves, three and half Feet long, and three and half In ches in Width; White-oak Barrel Staves, two and half Feet long, and thres and half Inches wide; White-oak Hogshead Heading, two and half Feet long, and fix Inches wide, and all free from Sap; all White-oak Barrel Staves to be ufed within this State, shall be two Feet and four inches long, and three inches and an half wide; all Black and Red-oak Hogshead Staves fhall be three and half Feet long, and three and half Inches wide; all French Sugar Hogshead Staves fhall be four Feet and feven Inches long, and three and half Inches wide; all Staves and Heading fhall be three quarters of an Inch thick in the thinneft Part; that all Cedar and Pine Shingles fhall be one Foot and fix Inches long, four Inches wide, and half an Inch in thickness at the Butt; that no Pine Boards shall be deemed merchantable, unless the same are an Inch thick. And if any Perfon or Perfons whatsoever, shall after the firft Day of March next, ship, or take on Board any Veffel within this State, any Quantity or Parcel of the a forementioned Sorts of Lumber for Exportation, which are not of the Dimen fions and Defcription aforefaid, the said Lumber so shipped or taken on Board, as aforefaid, contrary to this A&t, or the Value thereof, shall be forfeited by the Perion or Persons who ships, or takes the fame on Board, as aforefaid, one Half thereof to the Profecutor, and the other Half to the Treasury of this State; and the fame may be feized and proceeded with in the fame Way and Manner, as is provided in one Statute of this State, made for levying and collecting a Duty on the Exportation of Timber, &c.

And be it further enacted by the Authority aforefaid, That every Cafk of To bacco, that shall be hereafter packed and offered for Sale, within this State, fhall be branded with the Packer's Name and the Name of the Town where fuch Tobacco shall be packed, at full length; and whosoever fhall fell, or expose to Sale, any Cafk or Cafks of Tobacco, not branded as aforesaid, fhall forfeit and pay a Penalty of Forty Shillings for each and every fuch Cafk of Tobacco, to be recovered by any one who fhall fue for the fame.
