State Duties.

And provided nevertheless, That no Mafter of any Veffel or Boat, under the Burthen of thirty-five Tons, that may happen to come into fome Port, Harbour, River or Creek in this State, but bound to fome other Place in this State, or to fome other Place in another State, fhall by Force of this Act be compellable to make a Manifest of his Cargo, to the Collector of that Town in which fuch Veffel or Boat may happen fo to come, provided fuch Veffel or Boat do not continue in fuch Port or Harbour, more than seventy-two Hours, or in Cafe of being obliged by ftrefs of Weather do continue longer, the Maiter thereof do make Report to fuch Collector of her Cargo, as foon as may be after seventy-two Hours.

And be it further Enacted by the Authority aforejaid, That the Collector to whom the Master of any Vessel or Boat, under the Burden of thirty-five Tons, fhall make and exhibit a Manifeft agreeable to this Act, fhall be entitled to receive from fuch Mafter, Six Shillings, for receiving fuch Manifeft and adminiftering the Oath required thereto, and fhall alfo be entitled to receive for every Bond by him taken for Duties, the Sum of Two Shillings, and the refpective Naval Officers fhall be entitled to the fame Fees for like Services; and the Naval Officer to whom the Master of any Ship or Vessel, of thirty-five Tons Naval Offi- Burthen or more, shall make and exhibit a Manifeft according to this A&t. fhall be entitled to receive from fuch Mafter, Nine Shillings, for receiving fuch Ma nifeft and adminiftering the Oath required thereto; and Two Shillings for each Bond by him taken for the Payment of Duties.

And whereas it often happens that Goods, Wares and Merchandize, the Property of Citizens of the neighbouring States, are shipped on board of Ships, Veffels and Boats, the Property of the Citizens of this State, and imported into this State, in order to be from this State transported to fome other States,

Be it Enacted by the Authority aforefaid, That in all the Cafes aforefaid, fuch Goods, Wares and Merchandize, fhall be exempted from the Payment of the Goods in cer- Duties by this Act impofed, provided the Perfon Owner of fuch Goods, or fome Bain Cafes ex- other Person in his or their behalf, do within twenty-four Hours after the Ship, empt from

Veffel or Boat, in which the fame were imported into this State, as its Port of delivery in this State, become bound to the Naval Officer of the Port, if a Ship or Veffel of thirty-five Tons or more, or to the Naval Officer or Collector of the Town, if under the Burthen of thirty-five Tons, in a Sum equal to the Value of the Goods, Wares and Merchandize thus intended to be transported out of this State, that fuch Goods fhall not be fold in this State, but tranfported out therefrom within one Week; and the Naval Officer or Collector taking fuch Bond, fhall receive from the Perfon giving the fame, three Shillings Lawful Money.

And be it further Enacted, That when any Naval Officer, or Collector or Informing Officer, fhall by Virtue of this Act, feize and libel any Veffel, Boat, Goods, Wares or Merchandize, or fhall commence any Suit for the Recovery of any of the pecuniary Penalties of this Act, and fhall fail of fupporting fuch Libel, or fuch Action, the Coft of fuch Naval Officer, collector, or Informing Officer, fhall be defrayed out of the public Treasury of this State; and the Court before which the Trial is had, in either of the Cafes aforefaid, fhall tax fuch coft, and draw an Order therefor on the Treasurer of the State accordingly.

And be it further enased by the Authente aforesaid, That if any Perfon

And the Naval-Officers collecting Duties by Force of this Act, fhall be entitled to receive out of the Duties by them collected, at the Rate of two and a Naval Officer half per Cent. for their Labour, Trouble and Expence, in and about the Exe- 2 and a half cation of the Duties of their faid Office. And the Collectors appointed in pursuance of this Act, fhall be entitled to receive out of the Duties by them collected, at the Rate of five per Cent. for their Labour, Trouble and Expence, in and about the Execution of the Duties of their Office.

extend and the fame is hereby extended in every Article and Provifion thereof, to every intent and purpose to all Goods, Wares and Merchandize, not enume- Excife exrated in said Act, except the Growth and Manufacture of this or the United tended. States, that fhall from and after the first Day of July next, be fold by retail within this State; and that the Excife to be paid on all Articles to which faid A&t did extend, laying an Excife of five per cent. and to which it is hereby extended, shall be two and a half per cent. on the Value thereof, in Lawful Money, at the Time of purchafing or procuring the fame, by the Perfon or Perfons who shall retail or confume the fame, any Law, Ufage or custom to the contrary notwithstanding.

And whereas Doubts have arisen in fome Cales as to what shall be confidered felling by Retail within the Meaning of fald Act:

Be it further enacted by the Authority aforesaid, That all Sales that fhall hereafter be made in this State of imported Wine or diftilled Spirits, by lefs Quantity than forty Gallons; Bohea Tea by lefs Quantity than feventy five Pounds, other Teas by lefs Quantity than fifty Pounds; Coffee by lefs Quantity than one hundred Pounds neat weight: imported Chocolate by lefs Quantity than fifty Pounds; imported Loaf Sugar by lefs Quantity than one hundred Pounds neat weight; other imported Sugars by lefs Quantity than two hundred grofs weight; and all imported Salt by lefs Quantity than thirty Bushels at one Time, fhall be confidered a feiling by retail within the Meaning of faid A&t. And that all Sales that shall hereafter be made of any other Goods or Articles enumerated in faid Act, or to which the fame is by this Act extended as aforefaid to any Perfon or Perfons whatever, except by wholefale to fome Re tailers in this State duly licenced as in faid former Act is provided, and whofe Licence fhall be in force and produced to the Venders at the Time of fuch Sale, fhall be confidered a felling by retail, within the Meaning of this Act, and be fubject to the Payment of the Excife accordingly.

And be it further enacted by the Authority aforesaid, That the Excife for the future on all imported Wines fhall be nine Pence per Gallon; on all imported Brandy fix Pence per Gallon ; on all imported Geneva fix Pence per ditto; on all Bohea Tea four Pence per Pound; on all other India Tea one Skilling and fix Pence per ditto; on imported Chocolate two Pence per Pound; on all imported Malt Liquors fix Pence per Gallon; on all foreign Salt three Pence per Bufhel, and all brown Sugar half-penny per Pound; any Law, Ufage or Cuftom to the contrary notwithstanding.

And be it further enacted by the Authority aforefaid. That the Collectors of Excise fhall, upon their rendering their Accounts to the Treasurer of the State agreeable to the Provifion of faid Act, take a Certificate from the Treasurer of their having fo done, and lodge the fame with the Clerk of the County Courts in the County to which they refpectively belong, within one Month from the Time of taking the fame, on pain of forfeiting the Penalty of their said Bonds. And it shall be the Duty of the States Attornies in their respective Counties to enquire after fuch Certificates, and to profecute all delinquent Collectors for breach of this A&.

And be it further enacted by the Authority aforefaid, That for the future the feveral Collectors of Excife in this State fhall be entitled to receive only five per Cent. on the Monies collected, instead of seven and a half per Cent. which they have been heretofore allowed by faid Act.

An Act laying a Duty in certain Cafes.

WHERE AS a confiderable Part of the Expence arifing annually to this State, for the Support of Civil Government is incurred in the executive and judicial Departments. As an Expedient and further Mean of providing for the fame,

BE it enacted by the Governor, Council, and Representatives, in General Court affembled, and by the Authority of the fame, That there be laid and raised, for the Purpofe aforefaid, the following Duties or Sums, viz. On all Writs returnable for Trial before a fingle Minifter of the Law, One Shilling, to be paid at the Time of iffuing the fame, and to the Authority that shall fign them; on all Writs returnable for Trial before any court of common Pleas or city court, two Shillings, payable as aforefaid; on all Writs returnable for Trial before the Superior Court, fix Shillings, payable as aforefaid; on all Writs returnable for Trial before the Supreme court of Errors, twelve Shillings, payable as aforefaid; on all Appeals from a Judgment of a fingle Minifter of the Law, three Shillings, payable to fuch Minifter at the Time of granting the fame; on all Appeals from a Judgment of a court of common Pleas or a city court, fx Shillings, and on all continuances in the courts of common Pleas and city courts, nine Pence, and in the Superior Courts, one Shilling and fix Pence, payable to the clerks of fuch courts respectively at the Time of granting the fame: and on every Register of a Veffel taken out in this State, fix Shillings, payable in the Naval Office from whence the same shall issue, at the Time of taking out the fame.

And be it further enacted by the Authority aforefaid, That it thall be, and it is hereby made the Duty of each and every of the Officers aforefaid, who are made Receivers of faid Duties, annually, in the Month of May, by the twentieth Day of faid Month, to render an Account to the Treasurer of this

State of all Monies by them received in as aforefaid, specifying the Number of Writs and the Number of Appeals on which the fame has been received, and the fame after deducting fix Pence on the Pound, which shall be allowed them for their Trouble and Expence, punctually pay over to faid Treasurer. And that the Treasurer before the Expiration of faid Month of May annually, fhall make a Return to the General Affembly, of all faid Accounts returned to him, and of the Names of fuch Officers who are made Receivers as aforefaid, as fhall have neglected to return their Accounts to him as aforefaid.

And be it further enacted by the Authority aforesaid That no Writ, ferved after the firft Day of July next, or Appeal from the Judgment of a fingle Minifter of the Law taken after that Time, or other Appeal taken after the Rifing No Writ to of this Affembly, on which a Duty is laid as aforefaid, fhall be valid or authen be valid till tic in Law unless the Authority figning fuch Writ or certifying the Copies of the Duty is paid. fuch Appeal, fhall certify thereon in writing, that faid Duty thereon is paid,

Act for the direction of Lifters in their Office and Duty.

E it enacted by the Governor, Council and Representatives, in General Court affembled, and by the Authority of the fame, That every Ox or Steer of At what Ag four Years old and upwards, shall be fet in the Lift at Three Pounds; every Steer and Rate of three Years old, and every Cow or Heifer of three Years old and upwards, Cattle shall at Two Pounds; every Heifer or Steer of two Years old, at one Pound; all be fet in the Bulls more than one owned by one Perfon, shall be fet in the Lift at the Rate Lift. of Steers or Oxen of the fame Age. That all neat Cattle under two Years old, fhall be exempted out of the Lift. That the Lifters in the feveral Towns in this State, fhall fome time in the Month of September next, confider the DwellingCircumftances and Quality of each Dwelling-Houfe in faid Town refpectively; Houles, &c. and the Land adjoining thereto not exceeding one Quarter of an Acre, and fhall fet in the Lift of the Owner or Owners, of fuch Houfe or Houfes and Lands, the one Half of the Sum or Sums faid Lifters fhall judge faid Houle or Houfes and Lands would rent for annually. And that all Stores and Shops leafed or rented out for Storage or Merchandize, or Grounds rented for Build- Stores and. ings erected by others thereon, the Owner or Owners thereof, fhall be fet in Shops. the Lift one Half the annual actual Rent thereof, or the Value thereof to be eltimated by the Lifters as aforefaid. BE it enacted by the Governor, Council and Representatives, in General Court

affembled, and by the Authority of the fame, That for the future the Times and Places of holding the Superior and County Courts in the County of Fairfield, thall be as follows, viz. For the Superior Court at Fairfield, on the laft Tuesday fave two of Auguft annually, and at Danbury on the lait Tuesday fave two of February annually. And for the County Court at faid and place of Fairfield, on the third Tuesday of April annually, and at faid Danbury on the third Tuesday of November annually. And that any adjourned or fpecial Court may be holden at fuch Time and Place within either of faid Towns in faid County, as the refpective Courts fhall order and determine.
