SCHOOL ACT.

most Honorable Privy Council, dated the 12th Instant, in the Words following, vizt. :

Your Majesty having been pleased, by your Order in Council of the 30th of July, 1849, to refer unto this Committee, an Act of Tynwald passed in the Isle of Man, on the 5th of July, 1849, intituled "An Act for making better Provision for Parochial and other Schoolmasters, and for making further Regulations for the better Government of the Parochial and other Schools, in the Isle of Man :" The Lords of the Committee, in obedience to Your Majesty's said Order of Reference, have this Day taken the said Act into Consideration, and do agree humbly to report as their Opinion, to Your Majesty, that it may be adviseable for Your Majesty to approve of, and ratify the said Act.

Her Majesty having taken the said Act into Consideration, was pleased, by and with the Advice of her Privy Council, to approve thereof, and to order, as it is hereby ordered, that the said Act (which is hereunto annexed) be, and the same is hereby confirmed, finally enacted, and ratified accordingly: and the Right Honorable Sir George Grey, Bart., One of Her Majesty's principal Secretaries, is to take the necessary Measures herein accordingly.

An Act to provide for the more effectual Draining of
Land, and for other Purposes.

WHEREAS it is expedient to provide for the more effectual Draining of Fens, Marshy Grounds, and other Lands in this Island. Order in Writing, direct and mark out from a proper Level a sufficient and effectual Channel, Cut, Drain, commissioners or Outlet, according to the Nature and Situation of the Ground, for the effectually Draining of such Fens, Lands, and their Marshes, and other Lands; and such Order, when Order in writing made, shall be forthwith recorded by the Commis- the Rolls Office; sioners in the Rolls' Office; and when and after the Order to be said Commissioners shall have made their Order in Party applying the Premises, the Party so applying shall duly serve the Person or Persons through whose Grounds the said Channel, Cut, Drain, or Outlet, is so directed to be made, or who shall in anywise be affected thereby, with a certified Copy from Record of the said Order. LAND DRAINAGE said, the said Commissioners shall, and lawfully may, by Writing under their Hands, nominate and appoint a proper Overseer, effectually to carry on and complete the said Channel, Cut, Drain, or Outlet, through the Lands of such Person as shall refuse or neglect to obey the said Order; and such Overseer or Overseers appointed as aforesaid, shall, upon producing his or per Day for over their Accounts of the Expenses of the said Work, upon Oath before a Deemster, have Judgment and Execution granted against the Person so neglecting or refusing, for the full Amount thereof, together with an Allowance of Two Shillings and Sixpence each Day, for overseeing the said Work.

II. And be it further enacted, That it shall be pensation where lawful for the Commissioners, in any case where the Land of a Party Proprietor may have sustained, or be liable to sustain Damage, in consequence of the cutting of any Channel, Cut, Drain, or Outlet, through, near, contiguous to, or bordering upon such Land, to award Compensation to such Party, to be paid by the Party or Parties Proprietors who may be benefited by such Channel, Cut, Drain, or Outlet as aforesaid.

III. And be it further enacted, That in case any ers or Overseer to Person or Persons whatsoever, shall wilfully obstruct Prison, on affi- the said Commissioners, Overseer, or other Person employed by them in the Discharge of their Duty under this Act, it shall and may be lawful for the Governor or Lieutenant-Governor, upon Affidavit thereof to him made by the Commissioners or Overseer, to order the Offender or Offenders to be committed to Prison, there to remain until he, she, or they give in good and sufficient Security to offer no further Obstruction or Disturbance in the Premises; and, in the meantime, the said Work shall proceed as if no such Obstruction had been made.
