55 GEO. III, Cap. CXCIV.

An Act for better regulating the practice of Apothecaries throughout England and Wales.

29. Provided always, and be it further enacted, that nothing in this Act contained shall extend or be construed

These Duties are not repealed in the case of Oxford by 18 & 19 Vict. c. 36, nor in the case of Cambridge by 21 & 22 Vict. c. 11.

to extend to lessen, prejudice, or defeat, or in anywise to interfere with any of the rights, authorities, privileges, and immunities heretofore vested in and exercised and enjoyed by either of the two Universities of Oxford or Cambridge, the Royal College of Physicians, the Royal College of Surgeons, or the said Society of Apothecaries respectively, other than and except such as shall or may have been altered, varied, or amended in and by this Act, or of any person or persons practising as an Apothecary previously to the first day of August one thousand eight hundred and fifteen; but the said Universities, Royal Colleges, and the said Society, and all such persons or person shall have, use, exercise, and enjoy all such rights, authorities, privileges, and immunities, save and except as aforesaid, in as full, ample, and beneficial a manner, to all intents and purposes, as they might have done before the passing of this Act, and in case the same had never been passed.

55 GEO. III, Cap. xlix.

An Act for more effectually repairing the Road from Jesus Lane in the Town of Cambridge to the first Rubbing House on Newmarket Heath in the County of Cambridge.

["The Vice-Chancellor and Masters or Heads of the several Colleges and Halls in the University of Cambridge" for the time being are appointed Trustees of the Road to which the Act relates, known as "the Paper Mills Turnpike Road."]

56 GEO. III, Cap. CXXXVI.

An Act to enable His Majesty to grant certain lands, tenements, and hereditaments, escheated and devolved to His Majesty by the dissolution of Hertford College in the University of Oxford, and the site of the said College and buildings thereon, to the Chancellor Masters and Scholars of the said University in trust for the Principal and other Members of Magdalen Hall for the purpose of their removing to such site; and to enable the said Chancellor Masters and Scholars of the said University and the President and Scholars of Saint Mary Magdalen College to do all necessary acts for such removal.

[The Preamble of this Act recites a Charter, dated 5 Sept. 14 Geo. II, for the incorporation of Hertford College within Hart Hall in the University of Oxford; that part of the site of that College was held by lease from Magdalen College and part by lease from the University under certain reserved rents; that other parts of the site were subject to a rent charge of 17. 138. 4d. payable to Exeter College and to a rent charge of fourpence payable to Christ Church; that, under two Commissions of Escheat lately issued, it has been found by Inquisition in Oxfordshire and in Berkshire that Hertford College became dissolved on the 28th of June 1805, being then seised in fee of a certain piece of land, and possessed for certain terms of years of other pieces of land under lease from the University and from Magdalen College, with build

h This piece of land is described as containing by admeasurement 1982 square yards, and as bounded on the West partly by Cat Street and partly by land in private occupation, on the North partly "by a certain street leading from a Gate anciently called Smith's Gate to New College" and partly by the land held under lease from the University and from Magdalen College, on the East partly by New College Lane and partly by the stables of New College, and on the South by All Souls College.

ings thereon, situate in the parishes of St. Peter in the East and St. Mary the Virgin in Oxford, and also seised in fee of certain lands i in North Moreton in Berkshire, and that all these lands and terms of years had escheated to His Majesty by virtue of his prerogative royal; that the buildings of Hertford College are in a very ruinous state, and there is no fund applicable to putting them into repair; that Magdalen Hall is contiguous to Magdalen College, and an ancient School for the education of sixteen Choristers of the College forms part of the buildings of the Hall, and the freehold of the site of both Hall and School is vested in the College; that, the removal of the Hall and School being necessary to the completion of certain intended improvements at Magdalen College and being likely to conduce to the general improvement and ornament of the University, the President and Scholars of Magdalen College, with the concurrence and approbation of the Principal of Magdalen Hall, and with the consent of the Chancellor of the University as visitor and patron of the Hall, have proposed to the University to transfer the establishment of the Hall to the site of Hertford College, engaging to put the whole of the buildings thereof into complete repair, to relinquish to the use of the Hall all right and title to the part of Hertford College now held by lease under them, and to be at the sole expense of carrying this arrangement into effect; and that the University has agreed to the proposal.

[Section 1 enables His Majesty to grant the site of Hertford College and all or any part of the other lands to the University in trust for the Principal and other Members for the time being of Magdalen Hall.

[Sections 2 and 3 enable the President and Scholars of Magdalen College to make all needful alterations and repairs in the buildings of Hertford College, and to take down and rebuild such parts as in the judgment of the Vice-Chancellor and Delegates of Estates of the University cannot be effectually repaired; and also to convey the fee simple of the ground and buildings held by lease under them, without

These lands are described as "fourteen acres and three rods by estimation of arable land, and one acre and a half of meadow ground, more or less, lying dispersed in common fields and meadows of North Moreton."

consideration in money and without any rent or charge, to the University in trust for Magdalen Hall.

[Sections 4 and 5 provide that, as soon as the repairs are complete and the conveyance is made, the Principal and other Members of Magdalen Hall shall surrender possession of the Hall to the President and Scholars of Magdalen College, and shall "remove to and become established at the said dissolved College," which shall thenceforth "be called Magdalen Hall in the University of Oxford"; and that the removal shall in no way affect the rights and privileges appertaining to Magdalen Hall or to the Principal or any Member thereof, or to the University in relation thereto.

[Section 6 enables the Chancellor Masters and Scholars of the University to make the ground and buildings forming part of Hertford College which were held by lease under them a component part of Magdalen Hall, extinguishing the rents, and declaring by deed that they stand seised of the ground and buildings in trust for the Principal and other Members of the Hall.

[Sections 7, 8, and 9 provide that Magdalen College shall yearly pay to the Principal of Magdalen Hall the sum of 1l. 138. 4d., being the amount of the yearly rent charge due to Exeter College for part of the site, to the intent that such rent charge may be regularly paid, and that the Principal may be indemnified.

[Section 10 empowers Magdalen College to appropriate and annex the site and buildings of Magdalen Hall and the School adjoining, so soon as the Principal and other Members of the Hall shall have removed to the site of Hertford College, and a suitable School shall have been provided for the Choristers.

[Sections 11-17, after reciting that "the site and buildings of the said dissolved College may be greatly improved and made more ornamental, and the occupation of the same by its intended possessors rendered more convenient and desirable, if the front of the said dissolved College and also certain houses at the north and south ends thereof with a house in the occupation of Richard Paine leading to New i One of these houses, apparently towards the south end, comprised a “shop under Hertford College Library."
