Parliament, for and on the behalf of his faid Roman Catholick Subjects, to be accordingly drawn into Bills, and tranfmitted according to the ufual manner, to be afterwards paffed as Acts in the faid Parliament.

II. It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is graciously pleased to call a new Parliament to be held in this Kingdom, on or before the laft Day of November next enfuing, and that all Matters agreed on by these Articles to be paffed in Parliament, fhall be tranfmitted into England, according to the ufual Form, to be paffed in the faid Parliament, and that the faid Acts fo to be agreed upon, and fo to be paffed, fhall receive no Alteration or Diminution here or in England: Provided, that nothing fhall be concluded by both or either of the faid Houses of Parliament, which may bring prejudice to any of his Majesty's Proteftant Party, or their Adherents, or to any of his Majefty's Roman Catholick Subjects Party or their Adherents, other than fuch things as upon this Treaty fhall be concluded to be done, or fuch things as may be proper for the Committee of Privileges of either or both Houses to take Cognizance of, as in fuch Cafes heretofore hath been accustomed, and fuch other things as fhall be propounded to either or both Houfes by the Lord Lieutenant, or other chief Governor, or Governor for the time being, during the faid Parliament, for the Advancement of his Majefty's Service, and the Peace of the Kingdom, which Claufe is to admit no Construction, which may trench upon these Articles or any of them.

III. It is further concluded, accorded and agreed upon, by and between the faid Parties, And his Majefty is further graciously pleafed, that all Acts, Ordinances, and Orders made by both or either Houfes of Parliament, to the Blemish, Dishonour, or Prejudice of his Majefty's Roman Catholick Subjects of this Kingdom, or any of them, fithence the 7th of August, 1641. fhall be vacated, and that the fame, and all Exemplifications, and other Acts, which may continue the memory of them, be made void by Act of Parliament.

IV. It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is further gracioufly pleafed, that all Indictments, Attainders, Outlawries in this Kingdom, and all the Proceffes and other Proceedings thereupon, and all Letters Patents, Grants,

Leafes, Cuftodiams, Bonds, Recognizances, and all Records, Act or A&ts, Office or Offices, Inquifitions, and all other things depending upon, or taken by reafon of the faid Indictments, Attainders or Outlawries, fithence the 7th of August, 1641. in Prejudice of the faid Catholicks, their Heirs, Executors, Adminiftrators and Afligns, or any of them, or the Widows of them or any of them, fhall be vacated and made void in fuch fort, as no memory fhall remain thereof to the Blemish, Dishonour, or Prejudice of the faid Catholicks, their Heirs, Executors, Adminiftrators or Affigns, or any of them, or the Widows of them or any of them, and that to be done immediately after concluding of thefe Articles, and at furtheft before the first day of October next; or in Cafe the faid new Parliament be called fooner than the faid laft day of November, then forty days before the faid Parliament. And that all Impediments which may hinder the faid Roman Catholicks to fit or vote in the next intended Parliament, or to choose or to be chofen Knights and Burgeffes to fit or vote there, fhall be removed before the faid Parliament. Provided, that no Man fhall be queftioned by reafon of this Article for Mefne-rates or Wastes, faving wilful Wastes committed after the firft of November, 1645.

It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is further graciously pleafed, that all Debts do ftand in ftate as they were in the Beginning of thofe Troubles, and that no Grant or Difpofition made, or to be made thereof, by Virtue or Colour of any Attainder, Outlawry, Fugacy or other Forfeiture whatfoever, or otherwife, fhall be of Force, and this to be paffed as an Act in the faid next Parliament. VI. It is concluded, accorded and agreed, by and between the faid Parties, and his Majefty is graciously pleafed, that for the fecuring of the Eftates or reputed Eftates, of the Lords, Knights, Gentlemen and Freeholders, or reputed Freeholders, as well of Connaught, and County of Clare, or Country of Thomond, as of the County of Limerick and Tipperary, the fame to be fecured by Act of Parliament, according to the Intent of the 25th Article of the Graces, granted in the fourth Year of his Majefty's Reign, the Tenor whereof for fo much as concerneth the faid Propofition, doth enfue in thefe Words, viz. We are graciously pleafed, that for the fecuring of the Inhabitants of Connaught, and Country of Thomond, and County of Clare, VOL. III. C

that their feveral Eftates fhall be confirmed unto them and their Heirs, against Us, and our Heirs and Succeffors, by Act to be paled in the next Parliament to be holden in Ireland, to the End the fame may never hereafter be brought into further Question by Us, our Heirs and Succeffors, in which Act of Parliament fo to be paffed, you are to take care, that all Tenures in Capite, and all Rents and Services, as are now due, or which ought to be answered unto Us, out of the faid Lands and Premifes by any Letters Patents paft thereof Since the first Year of King Henry the Eighth, or found by any Office taken from the faid firft Year of King Henry the Eighth, until the 21ft of July, 1615. whereby our late dear Father, or any his Predeceffors actually received any Profit, by Wardhip, Liveries, primer Seifins, Mefne-rates, Oufter le mains, or Fines of Alienations without Licence, be again referved unto Us, our Heirs and Succeffors; and all the rest of the Premifes to be holden of our Castle of Athloane, by Knights Service, according to our faid late Father's Letters, notwithStanding any Tenures in Capite found for Us by Office fince the 21st of July, 1615. and not appearing in any such Letters Patents, or Offices. Within which Rule it is his Majefty's Pleafure, and it is fo concluded and agreed, that the faid Lands in the Counties of Limerick and Tipperary, be included, but to be held by fuch Rents and Tenures only as they were in the fourth Year of his Majefty's Reign: Provided always, and it is the Intention of the faid Parties to thefe Prefents, that the faid Lords, Knights, Gentlemen and Freeholders, or reputed Freeholders, of the faid Province of Connaught, County of Clare, and County of Thomond, and Counties of Tipperary and Limerick, fhall have and enjoy the full Benefit of fuch Compofition and Agreement, which fhall be made with his mot Excellent Majefty for the Court of Wards, Tenures, Refpites and Iffues of Homage, any Claufe in this Article contained to the contrary notwithstanding: And as for Lands within the Counties of Kilkenny, and Wickloe, unto which his Majefty was intitled by Offices taken or found in the time of the Earl of Strafford's Government in this Kingdom; his Majefty is gracioufly pleased, that the State thereof, fhall be confidered in the next intended Parliament, wherein his Majefty will affent unto that which fhall be juft and honourable: And it is further concluded and agreed, by and between the faid Parties, and his Majefty is further graciously pleased, that the like Act of Limita

Limitation of his Majefty's Titles for the Security of the Eftates of his Subjects of this Kingdom, be paffed in the faid Parliament, as was Enacted in the 21ft Year of his late Majefty King James's Reign in England.

VII. It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is further graciously pleafed, that all Incapacities, impofed upon the Natives of this Kingdom, or any of them as Natives, by any Act of Parliament, Provifoes in Patents, or otherwife, be taken away by Act to be paffed in the faid Parliament; and that they may be enabled to erect one or more Inns of Courts, in or near the City of Dublin, and that fuch Students, Natives of this Kingdom, as fhall be therein, may take and receive the ufual Degrees accustomed in any Inns of Court, they taking the enfuing Oath, viz. I A. B. do truly acknowledge, profefs and declare in my Confcience, before God and the World, that our Sovereign Lord King Charles is Lawful and Rightful King of this Realm, and of other his Majesty's Dominions and Countries, and I will bear Faith and true Allegiance to his Majefty, and his Heirs and Succeffors, and him and them will defend to the uttermost of my Power, against all Confpiracies and Attempts whatsoever, which fhall be made against his or their Crown and Dignity; and do my best endeavour to difclofe and make known to his Majefty, his Heirs and Succeffors, or to the Lord Deputy or Governors for the time being, all Treafons or Traiterous ConSpiracies which I shall know, or hear to be intended against his Majefty or any of them; and I do make this Recognition and Acknowledgment heartily, and willingly, and truly, upon the true Faith of a Chriftian: So help me God. And that they may erect one or more Univerfities, to be governed by fuch Rules and Orders as his Majefty fhall appoint: And it is further concluded and agreed, by and between the faid Parties, and his Majefty is gracioufly pleafed, that the faid Roman Catholick Subjects may erect and keep free-Schools for Education of Youth in this Kingdom, any Law or Statute to the contrary notwithstanding. All the Matters of this Article to be paffed as Acts of Parliament in the faid next Parliament.

VIII. It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is graciously pleafed, That Places of Command, Honour, Profit, and Truft in his Majefty's Armies in this Kingdom, hall be upon Perfection of thefe Articles actually, and by

particular Inftances conferred upon his Roman Catholick Subjects of this Kingdom; and that upon the Distribution, conferring and difpofal of the Places of Command, Honour, Profit and Truft in his Majefty's Armies in this Kingdom for the future, no difference fhall be made between the faid Roman Catholicks, and other his Majesty's Subjects, but that fuch Diftribution fhall be made with equal indifferency, according to their respective Merits and Abilities; and that all his Majefty's Subjects of this Kingdom, as well Roman Catholicks as others, fhall for his Majefty's Service and their own Security, arm themselves the beft they may, wherein they fhall have all fitting Encouragement; and that Places of Command, Honour, Profit and Truft in Civil Government in this Kingdom, fhall be, upon paffing of the Bills, in thefe Articles mentioned, in the next Parliament, actually and by particular Inftances conferred upon his Majefty's Roman Catholick Subjects of this Kingdom; and that in the Diftribution, conferring and difpofal of the Places of Command, Honour, Profit and Truft, in the Civil Government for the future, no difference fhall be made between the faid Roman Catho licks and others his Majefty's Subjects, but that fuch Dif tribution fhall be made with equal indifferency, according to their refpective Merits, and Abilities; and that in the Diftribution of Minifterial Offices, or Places which now are or hereafter fhall be void in this Kingdom, Equality fhall be used to the Roman Catholick Natives of this Kingdom, as to other his Majefty's Subjects; that the Command of Forts, Caftles, Garifons, Towns, and other Places of importance in this Kingdom, fhall be conferred upon his Majefty's Roman Catholick Subjects of this Kingdom upon perfection of thefe Articles, actually and by particular In tances and that in the Diftribution, conferring and dif pofal of the Forts, Caffles, Garifons, Towns and other Places of Importance in this Kingdom, no difference fhall be made between his Majefty's Roman Catholick Subjects of this Kingdom, and other his Majefty's Subjects, but that fuch diftribution fhall be made with equal indifferency, according to their refpective Merits and Abilities.

IX. It is further concluded, accorded and agreed upon, by and between the faid Parties, and his Majefty is further graciously pleased, That his Majefty will accept of the yearly Rent or annual Sum of Twelve Thoufand Pounds Sterling, to be applotted with indifferency and equality,
