A message from the Senate by their Clerk

Mr. Speaker--The Senate concur with the House of Representatives, in the passage of the following bills and resolutions.

An act allowing compensation to the Selectmen of Shelburne and others.

An act to change the name of Piercy, to the name of Stark. An act to incorporate sundry persons, by the name of the Wentworth Mechanic Association.

An act allowing compensation to John H. White and others. A resolution granting a certain tract of land to Abel Crawford. A resolution directing the Secretary of State, to purchase three sets of the New-Hampshire reports, and the New-York reports for the use of the State Library.

Also, in a bill entitled, An act to incorporate Colebrook Academy, with certain amendments, in which amendments they ask the concurrence of the House."

The House proceeded to the consideration of the amendments proposed by the Senate, to the bill entitled, An act to incorporate Colebrook Academy.

Which amendments were severally read and agreed to.

Ordered, That the Clerk inform the Senate thereof.

Mr. Kimball, from the committee on Bills on their second reading, to whom was referred the bill entitled, An act to incorporate a Company, by the name of the New-Hampshire Bridge, reported the same in a new draft.

Which was read a first and second time.

On motion of Mr. Hull-That the bill lie on the table and be made the order of the day, for Thursday next. It was decided in the negative.

Mr. Wilcox, introduced the following resolutions,

Resolved, That the further consideration of the bill entitled, An act to incorporate a company by the name of the New-Hampshire Bridge, be postponed to the next session of the Legislature.

Resolved, That the Justices of the Superior Court be requested to transmit to this House at its next session, their opinions on the following questions.

1. Can the Legislature of this State constitutionally grant to certain individuals named in the grant, the exclusive right of erecting a toll bridge over a navigable river in this State, within prescribed limits? And if such grant be made and excepted by the granters, and a toll bridge be erected accordingly, Can the Legislature constitutionally make a new grant to other persons, to erect

a toll bridge within the limits of the first grant without the consent of the proprietors of said first grant, or without making them any compensation for the damage they may sustain from such subsequent grant?

2. If the limits named in the first grant of a toll bridge made as aforesaid include an ancient ferry, subsisting at the time of the grant and if it does not appear that the proprietors of said ferry, ever consented or objected to said grant, or to the erection of said toll bridge, or ever made any claim for damages occasioned to them thereby, and if said ferry has now been discontinued for more than twenty years, will circumstances so effect the first grant of a toll bridge made as aforesaid, that the Legislature can now constitutionally grant a new toll bridge, when said ferry was situated without the consent of the proprietors of the first grant aforesaid for a toll bridge, or without making them any compensation for the loss they may sustain ?

3. Resolved, That the Clerk of this House transmit to each of the Justices of the Superior Court, an attested copy of the preceding resolutions as soon as may be.

Mr. Smith of Lempster, pursuant to notice given on Friday last, had leave to introduce a bill entitled, An act in addition to an act entitled, an act directing the returns of statements every year, from the several banking corporations in this State.

• Ordered, That said bill be referred to the committee on Banks. Pursuant to notice given yesterday, Mr. Eastman had leave to introduce a bill entitled, An act to incorporate the President, Directors and Company of the Lancaster Bank.

Mr. Nesmith, from the committee on Bills on their second reading, to whom was referred the bill entitled, An act to establish the rates at which polls and rateable estate shall be valued in making direct taxes by leave of the House, reported the same in a new draft. Which was read a first and second time.

The House resumed the consideration of the bill entitled, An act to incorporate the President, Directors and Company of the Suncook Bank.

On motion of Mr. Gove of Goffstown

Ordered, That said bill be referred to the committee on Banks. And then the House adjourned.

WEDNESDAY DEC. 19, 1832. Mr. Albee, presented the petition of Aaron Brackett and others, for a bank charter in the town of Littleton.

Ordered, That it be referred to the committee on Banks.

Mr. Gove, from the committee on the Judiciary, to whom was referred the bill entitled, An act relating to the organization of the Courts of Justice, reported the same with sundry amendments, which amendments were read and adopted.

Mr. Nesmith moved, that the 9th section be amended by inserting the following words, after the word "donor," "and'shall have power to do a specific performance af all executory contracts," which amendment was read and adopted.

Mr. Gove of Goffstown, moved certain amendments to the 21st section, which amendments were read, and on the question for adoption,

It was decided in the negative.

Ordered, That said bill be read a third time to-morrow at 10 o'clook, forenoon.

Mr. Gibson, from the committee on Agriculture and Manufactures, to whom was referred the resolution as to the expediency of an alteration in the law in relation to rams, reported a bill entitled, An act to promote the increase of sheep.

Mr. Gibson, from the same committee, to whom was referred the resolution as to the expediency of amending the law in relation to the survey of shingles and clapboards, reported a bill entitled, An act regulating the survey of sawed clapboards and shingles. Which was read a first and second time.

Mr. Marston, from the committee on Roads, Bridges and Canals, to whom was referred the petition of Stephen Perley and others, made a report; whereupon,

Mr. Litchfield, from the committee on Education, to whom was referred the bill entitled, An act in addition to an act entitled, an act empowering school districts to build and repair school houses, made a report, whereupon,

Mr. Hale, gave notice that he should to-morrow ask leave to introduce a bill entitled, An act to incorporate John B. H. Odiorne and his associates, for the purpose of constructing locks and canals, from the outlet of the Winnipisiogee Lake to Sandbornton Bay.

Mr. Colby, of Weare, gave notice that he should to-morrow ask leave to introduce a bill entitled, An act for the support and regulation of primary schools, passed July 6, 1827.

Mr. Kingman, pursuant to notice given on Saturday last, had leave to introduce a bill entitled, An act regulating the office of constable.
