To His Excellency Samuel Dinsmoor, Commander in chief of the militia of New-Hampshire. The Senate and House of Representatives in General Court convened, represent to your Excellency, That the following persons have been duly appointed and commissioned, as officers of the militia of the State of New-Hampshire, and have removed and gone to reside without the limits of their respective commands, and have neglected to resign their commissions, viz. Lyman Huntoon, 1st Lieutenant of the company of Cavalry, in the 16th regiment, Uriel Hall, Ensign of the fifth company of Infantry, in the said 16th regiment, Andrew T. Pierce, Lieutenant of the first company, and Moulton Taylor Lieutenant of the fourth company of Infantry, in the the second regiment, John Gove and Aaron B. Hoyt, Captains of Infantry, in the 19th regiment. For which causes, the Senate and House of Representatives respectfully request Your Excellency, to remove the aforesaid persons from their respective commands in conformity with the provisions of the Constitution. Which was read. Resolved, That it pass. Ordered, That the Clerk inform the Senate thereof. Mr. Wentworth from the same committee to whom was referred the petition of James Berry and others, made a report, whereupon, Resolved, That it is inexpedient to grant the titioners. prayer of said pc Mr. Wentworth from the same committee to whom was referred the resolution in relation to the return of the public arms to the arsenal, made a report, whereupon, Resolved, That the further consideration of said resolution be postponed to the next session of the Legislature. Mr. Putnam from from the committee on the Judiciary to whom war referred the bill entitled, An act for taxing bank stock in certain cases reported the same without amendment. On motion of Mr. Wilcox- Resolved, That the rules of the House be so far suspended as to permit said bill to be read a third time at the present time. Said bill was read a third time. Resolved, That it pass and that its title be as aforesaid. Ordered, That the Clerk request the concurrence of the Senate therein. On motion of Mr. Carroll- Resolved, That the rules of the House be so far suspended that all bills and resolutions, heretofore introduced at the present session, may be read a first, second and third time on the same day in which they may be introduced. Resolved, That in making up the pay roll of the members of this House, the Clerk be directed to include the first day of the session, in the case of such members as were in town on said day, although their names do not appear on the Journal, till the second day of the session. Mr. Sawyer of Swanzey introduced the following resolution, That in order to enable the Clerk to make an equitable pay roll for the attendance of the members of the House of Representatives, the present session, That the roll be called and that each member be requested to state the number of days he has given his personal attendance in the Legislature, during the present session, including Sundays and also to-morrow. Which was read. Mr. Freese moved, That the resolution lie on the table. Mr. Tebbetts moved, That the further consideration of said. resolution be postponed to the next session of the Legislature. On this question, the yeas and nays were required by Mr. Wilson of Haverhill.
