It was determined, in the affirmative.

A message from the House of Representatives by their Clerk. "Mr. President: The House of Representatives have indefinitely postponed the bill entitled, An act in addition to an amendment of an act, entitled An act to declare the jurisdiction of the Court of Common Pleas, and of the Superior Court of Judicature, and to regulate the proceedings in the same Courts, passed Jan. 2, 1829." And he withdrew.

Mr. Drown, from the committee on Engrossed Bills, reported, that they had laid the nine bills and address last reported by the committee on engrossed bills as correctly engrossed, before his Excellency the Governor.

The bill entitled, An act to establish the rates at which polls and rateable estates shall be assessed in making direct taxes--was read a third time.

Mr. Drown voted in the negative.

A message from the House of Representatives by their Clerk. "Mr. President: The House of Representatives disagree to the amendment proposed by the Hon. Senate to the bill entitled, An act to distribute among the several towns in this State the 3 per cent. stock due this State from the United States."

And he withdrew.

Mr. Williams moved that the Senate recede from their said amendments.

A message from the House of Representatives by their Clerk. "Mr. President-The House of Representatives have passed a bill entitled, An act regulating the office of constable.

An act to incorporate sundry persons by the name of the Francestown Bank. And

A resolution granting one copy of Carrigain's map to the town of Middleton, in which they request the concurrence of the Sen

ate.

The House of Representatives adhere to their disagreement to the amendments proposed by the Hon. Senate, to the bill entitled, An act to distribute among the several towns in this State the three per cent. stock due this State from the United States."

And he withdrew.

The bill entitled, An act to incorporate sundry persons by the name of the Francestown Bank, was read a first and second time. Ordered, That the same be referred to the committee on Banking Institutions.

The resolution granting a copy of Carrigain's map to the town of Middleton, was read a first and second time.

Ordered, That the same be referred to the committee on Claims. A message from the House of Representatives by their Clerk. "Mr. President-The Hosue of Representatives adhere to their disagreement to the amendments proposed by the Hon. Senate, to

the bill entitled, An act to distribute among the several towns in this State the three per cent. stock due this State from the United States, and ask a committee of conference-and have on their part appointed Messrs. Atwood, Colby of Weare, and Chamberlain." And he withdrew.

On motion by Mr. Burns

Ordered, That the same lie on the table.

Mr. Williams from the committee on the Judiciary, to whom was referred the bill establishing a new proportion for the assessment of taxes, reported the same without amendment.

It was determined in the affirmative.

On motion by Mr. Farrington

The resolution fixing the time at which the business of the present session of the Legislature may be closed, was taken up and considered.

Resolved, That it pass.

Ordered, That the Clerk notify the House of Representatives accordingly.

Mr. Woodbury, from the committee on the State House and State House Yard, to whom was referred the resolution instructing them to report what measures it will be necessary to take to secure the foundations of the State House against damage by water, reported, that in the opinion of the committee there should be troughs placed under the eaves of the State House, and conductors to carry the water to shoes made of stone, to prevent it from injuring the House. The ground upon which the building stands being sandy, has settled so as to break some of the stones, and open the joints of others; but that the committee were of opinion that the repairs had better be delayed until the building should need shingling anew, which would be in a short time-and therefore that it is inexpedient to make any repairs at the present time.

On motion-

Resolved, that said report be accepted.

The bill entitled, An act for making and establishing a new proportion for the assessment of public taxes among the several towns and places within this State--was read a third time.

Resolved, that it pass.

Ordered, That the Clerk notify the House of Representatives accordingly.

Mr. Knowlton, from the committee on Claims, to whom was re

ferred the resolution granting one of Carrigain's maps to the town of Middleton-reported the same without amendment. On the question, Shall this resolution be read a third time? It was determined in the affirmative.

On motion by Mr. Jackson-

Resolved, That the Rules of the Senate be so far suspended, that said resolution be read a third time at the present time. Whereupon said resolution was read a third time.

Resolved, that it pass.

Ordered, That the Clerk notify the House of Representatives accordingly.

Mr. Williams, from the committee on the Judiciary, to whom was referred the bill entitled, An act for the preservation of Bath Village Bridge--reported the same with amendments.

On the question, Will the Senate agree to the first amendment proposed by the committee, viz: Strike out all the preamble of said bill?

It was determined in the affirmative.

On the question, Will the Senate agree to the second amendment proposed by said committee, viz: In the 5th line below the preamble strike out the words "said bridge," and insert in lieu thereof the words "any bridge in this State belonging to any town or corporation.'

It was determined in the affirmative.

On the question, Will the Senate agree to the third amendment proposed by said committee, viz: In the last line before the proviso of the bill, strike out the words " said town of Bath," and insert in lieu thereof the words "such town or corporation"?

It was determined in the affirmative.

On the question, Will the Senate agree to the fourth amendment proposed by said committee, viz: Strike out all the proviso of the bill, and insert in lieu thereof the following:

"Provided however, that no town or corporation shall be entitled to the provisions of this act, until such town or corporation shall have erected at or near each end of said bridge or bridges, as they wish protected by this act, in some conspicuous place, a board or boards with an inscription painted on the same, signifying the penalty as aforesaid; and shall have chosen an agent, whose duty it shall be to prosecute for all penalties incurred under this act"?

It was determined in the affirmative.

On the question, Shall the bill as amended be read a third time ? It was determined in the affirmative.

On motion by Mr. Williams

Resolved, That the Rules of the Senate be so far suspended, that said bill be read a third time at the present time.

Whereupon said bill as amended was read a third time.

Resolved, that it pass with amendments.

Mr. Williams proposed to amend the title of the bill by striking out the words "Bath Village Bridge," and inserting in lieu thereof the word "Bridges."
