On motion by Mr. Knowlton

The address for the removal of one of the Justices of the Superior Court of Judicature, was taken up and acted on.

Mr. Knowlton offered the following amendment to the Address, viz. after the word "Harris" strike out the words "one of the," and insert in lieu thereof the words "Hon. Samuel Green and the Hon. William M. Richardson."

On the question, Will the Senate adopt the said amendment?. It was determined in the negative.

On the question, Shall the address pass?

The yeas and nays were required by Mr. Knowlton.

Those who voted in the affirmative are-Messrs. Drown, Bartlett, Carr, Whittemore, Farrington, Bean, Woodbury, Jackson, Burns and Williams.

Mr. Knowlton voted in the negative.

A message from the House of Representatives by their Clerk. "Mr. President--The House of Representatives have passed a bill entitled, An act to distribute among the several towns in this State, the 3 per cent stock due this State from the United States.

A bill entitled, An act to establish the rates at which polls and rateable estates shall be assessed in making direct taxes.

A bill entitled, An an act in addition to and in amendment of an act entitled, An act for the support and regulation of primary schools, passed July 6, 1827.

An act for making and establishing a new proportion for the as. sessment of public taxes among the several towns and places with in this State. And

A resolution directing the Warden of the State Prison to collect outstanding demands in favor of the Prison and providing for the completion of the new Prison-In which they request the concur rence of the Senate."

I am also directed to inform the Hon. Senate that the House of Representatives have passed a resolution, that when the House adjourn at noon, it adjourn to meet at 3 o'clock in the afternoon; and when it adjourns in the afternoon, it adjourn to meet again at 6 o'clock in the evening; and when it adjourns in the evening, it adjourn to meet at 9 o'clock in the morning, during the remainder

of the session."

And he withdrew.

Ordered, That the same be referred to a select committee. Ordered, That Messrs. Drown, Jackson and Knowlton be the committee.

The bill entitled, An act to establish the rates at which polls and rateable estates shall be assessed in making direct taxes-was read a first and second time.

Ordered, That the same be referred to the committee on the Judiciary.

Ordered, That the same be referred to the committee on Schools and Seminaries of Learning.

The bill entitled, An act for making and establishing a new proportion for the assessment of public taxes among the several towns and places within this State-was read a first and second time. Ordered, That the same be referred to the select committee on Inventories.

Mr. Jackson, from the committee on Schools and Seminaries of Learning, to whom was referred the bill entitled, An act to incorporate the trustees of Lebanon Academy-reported the same with amendments.

On the question, Will the Senate agree to the first amendment proposed by said committee, viz. In the 4th line of the 1st section of the bill, after the word "Grafton," insert the following words: "for the education of youth in the various branches of literature"? It was determined in the affirmative.

On the question, Will the Senate agree to the second amendment proposed by the committee, viz. In the 12th line of the first section, after the word "privileges," insert the following words: "and subject to all the liabilities"?

It was determined in the affirmative.

On the question, Shall the bill as amended be read a third time?
It was determined in the affirmative.

Mr. Burns, from the committee on the Judiciary, to whom was referred the resolution directing the Warden.of the State Prison to collect outstanding demands in favor of the Prison, and providing for the completion of the new Prison-reported the same without amendment.

On the question, Shall the resolution be read a third time?
It was determined in the affirmative.

On motion by Mr. Burns

Resolved, That when the Senate adjourn in the afternoon, it be to meet again at 9 o'clock in the forenoon of the next day, until otherwise ordered.

Mr. Drown, from the select committee to whom was referred the bill entitled, An act to distribute among the several towns in this State the 3 per cent. stock due this State from the United States-reported the same without amendment, and recommend that the Senate do not concur with the House in the passage thereof.

The bill entitled, An act to incorporate the trustees of the Lebanon Academy as amended, was read a third time.

A message from the House of Representatives, by their Clerk. "Mr. President the House of Representatives have passed a resolution fixing the time at which the buisness of the present session of the Legislature may be closed--in which they ask the concurrence of the Senate."

And he withdrew.

Said resolution was read, and is as follows:

Resolved, That the business of the present session may close on Saturday the 5th day of Jan. 1833, and that the Clerk be directed to make up the pay roll accordingly.

Mr. Drown from the committe on Engrossed Bills, reported that they have examined and found correctly engrossed bills with the following titles, viz:

An act to alter the names of certain persons.

An act in addition to the several laws of this State for the case and relief of poor debtors.

An act regulating the mode of putting pine timber into Connecticut River.

An act in amendment of an act entitled, An act relating to the organization of the courts of justice.

An address for the removal of one of the justices of the superior court of judicature.

An act to incorporate the Proprietors of Sewall's Falls Bridge. An act in addition to an act entitled, An act empowering the inhabitants of the town of Portsmouth to appoint health officers, and for preventing nuisances in said town.

An act relating to students of colleges.

An act to incorporate the Newport Manufacturing Company. And An act authorizing selectmen to tax the rateable estates of legatees and wards, in the bands of executors, administrators, trustees and guardians.

A message from the House of Representatives by their Clerk. "Mr. President--The Speaker of the House of Representatives having signed the nine bills, and the address last reported by the committee on engrossed bills as correctly engrosed, I am directed to bring them to the Senate for the signature of their President." And he withdrew.

The President of the Senate signed the said bills and address, and they were delivered to the committee on Engrosed bills to be laid before His Excellency The Governor.

The bill entitled, An act to distribute among the several towns in this State the three per cent. stock due this state from the United States, was taken up and considered.

Mr. Whittemore offered the following amendment, viz: Strike out after the word "New-Hampshire," in the 8th line of the 1st section, all the remainder of the bill, and insert the following words, "to place the same at interest in some bank or banks, and apply the same to defray the ordinary expenses of the State as they may accrue, under the direction of His Excellency the Governor, until the whole shall be expended."

On the question, Will the Senate adopt the said amendment? The yeas and nays were required by Mr. Williams.

Those who voted in the affirmative arc-Messrs. Drown, Bartlett, Carr, Whittemore, Farrington, Bean, Woodbury, Knowlton and Jackson.

Those who voted in the negative are--Messrs. Burns and Williams.

On the question, Shall the bill as amended be read a third time? It was determined in the affirmative.

On motion by Mr. Drown

Resolved, That the Rules of the Senate be so far suspended, that said bill be read a third time at the present time.

Whereupon said bill as amended was read a third time. Resolved, That it pass with an amendedment.

Mr. Whittemore offered the following amendment to the title of the bill, viz:
