A message from the Senate by their Clerk.

"Mr. Speaker-The Senate concur with the House of Representatives in the passage of a resolution declaring at what time the present session of the legislature may close."

Mr. Copp, from the select committee to which was referred so much of His Excellency's message as relates to the State Prison; also His Excellency's message transmitting the report of the Warden, ChapJains and Physicians; also the report of the agent for building the new prison, made a report accompanied with the following resolution: Resolved by the Senate and House of Representatives in General Court convened, That the sum of four thousand dollars be and the same is hereby appropriated for the purpose of erecting and finishing the new cells in the State prison agreeably to the plan adopted at the last June session.

And be it further resolved, That His Excellency be and he is hereby authorized by and with consent of Council to draw his warrant on the treasury for such sums as may be found necessary for the purpose aforesaid and not exceeding 4000 dollars.

Which was read a first and second time.

Mr. Wentworth, from the committee on Military Affairs to whom was referred the petition of the officers of the twenty-eighth Regiment for the removal of an officer, reported the following address: To His Excellency Samuel Dinsmoor, Captain General and Commander in Chief of the Militia of New-Hampshire :

The Senate and House of Representatives in General Court convened represent to your Excellency that Daniel Minor has been duly appointed a Captain of the second company of infantry in the twentyeighth regiment of the militia of the State of New-Hampshire, and that he has, from habits of intemperance, rendered himself unable to

perform his duty as an officer.

For which cause the Senate and House of Representatives respectfully request your Excellency to remove the aforesaid Daniel Minor from his respective commands, in conformity with the provisions of the constitution.

Which was read.

Resolved, That it pass. "

Ordered, That the Clerk inform the Senate thereof.

Mr. Wentworth, from the same committee to which was referred the petition of Daniel Waldron, of Samuel Woodbury and of the officers of the 28th regiment for the removal of certain officers, reported the following address:

To His Excellency Samuel Dinsmoor, Captain General and Commander in Chief of the Militia of New-Hampshire :

The Senate and House of Representatives in General Court convened,represent to your Excellency that the following persons have been duly appointed and commissioned as officers of the militia of the State of New-Hampshire; and have removed and gone to reside without the limits of their respective commands, and have neglected to resign. their respective commissions, viz: Joseph T. Hubbard, Captain, Levi Hoyt, Lieutenant and Jonathan Weeks, Ensign, of the first company of infantry in the 39th Regiment; William H. Derby, Captain of the company of cavalry in the 23d regiment; and Smith Sandborn, Ensign of the second company of infantry in the 28th regiment.

For which cause the Senate and House of Representatives respectfully request your Excellency to remove the aforesaid persons from their respective commands in conformity with the provisions of the constitution.

Which was read.

Resolved, That it pass.

Ordered, That the Clerk inform the Senate thereof.

'Mr. Wilcox, from the select committee to which was referred the message of His Excellency transmitting a communication from the government of Massachusetts on the subject of the northeastern boundary and the award of the King of the Netherlands, made a report, whereupon

Resolved, That it is inexpedient at this time to legislate upon that subject.

Mr. French, from the committee on Engrossed Bills, reported, That they have presented to His Excellency the Governor for approval all the bills which they this day reported to the House as being correctly engrossed.

Mr. Webster, from the select committee to whom was referred the message of His Excellency the Governor and the accompanying resolutions from the State of Maine in relation to a system of internal improvement; also sundry resolutions of the General assembly of the

State of Tennessee, made a report accompanied with the following. resolutions :

1. Resolved, That in the opinion of the House, the Constitution of the United States has not vested in Congress the right to adopt and execute, at the national expense, a system of internal improvement."

2. Resolved, That the tariff of duties en imports ought so to be modified if possible, a due regard being had to all interests of the country, that the receipts from them and other sources of revenue into the treasury of the United States shall not greatly exceed the annual expenses of the Government.

3. Resolved, That if with a due regard to all the essential interests of the country, the duties on imports cannot be so reduced that no surplus fund shall remain in the national treasury, after paying the ordinary and necessary annual expenses of the government, such surplus ought to be equitably distributed among the several States in a mode and by a rule to be prescribed by an amendment to the constitution.

4. Resolved, That it is inexpedient to legislate about the disposal of the public lands until after the payment of the public debt.

5. Resolved, That this House deprecate that Congress have assumed the power to appropriate the public money to be expended on the local objects of improvements within the States, and in subscribing for stock under State incorporations.

6. Resolved, That this House approve the sentiments of the President of the United States in relation to internal improvements by the General Government, as expressed in his veto message communicated to the Congress of the United States upon the Lexington and Maysville Turnpike Road Bill.

7. Resolved, That the Secretary of State furnish a copy of this report and resolutions to each of our Scnators and Representatives in Congress and to the Executives of the States of this Union.

Mr. Miller, from the committee on Finance, introduced the following resolution :

Resolved, That His Excellency the Governor be and he hereby is requested to take proper means to ascertain the number of deaf and dumb persons in this State who are proper objects of assistance from the State, and generally to collect such information upon those important subjects as may be practicable, and to communicate the same to this House for their information at the next session of the legislature, and also to communicate to this House Who are the State beneficiaries at the American Asylum, and the amount of money appropriafed to each, the amount of money expended by the State for the education of the deaf and dumb, and the amount of State appropriations unexpended and the amount expended. by individuals inhabitants of this State

for educating the deaf and dumb at Hartford in addition to the appropriation made for that purpose.

Which was read.

Resolved, That it pass.

Pursuant to notice given on the 18th inst. Mr. Gove of Goffstown moved that the House reconsider the vote postponing to the next session of the legislature a resolution granting a copy of the revised statutes to the place called Bretton Woods.

On the question, Shall the vote be reconsidered ?

It was decided in the affirmative.

On motion of Mr. Gove

That the resolution be amended by striking out the words "place called Bretton Woods" and insert the words "town of Carroll,"

Mr. Gove of Goffstown introduced the following resolution.

Resolved by the Senate and House of Representatives in General Court convened, That His Excellency the Governor be, and hereby is authorized to draw on the treasury for a sum not exceeding five hundred dollars to defray the contingent expenses of the State for the year ensuing.

Which was read three several times.

Resolved, That it pass.

Ordered, That the clerk request the concurrence of the Senate therein.

"Mr. Speaker-The Senate concur with the House of Representatives in the passage of the following bills, resolutions and address. "An act. to incorporate a town by the name of Carroll."

"An act in favour of Ralph Metcalf and others."

"An act to incorporate Pearson Cogswell and his associates by the name of the Gilmanton Manufacturing Company."

"An act entitled an act to repeal the seventh and eighth sections of the act to incorporate the proprietors of the Meredith Cotton and Woollen Factory."

A resolution in favour of Philip Carrigain.

A resolution authorizing the Treasurer to borrow thirty thousand dollars for the use of the State.

An address for the removal of certain military officers.

Mr. Gove of Goffstown introduced the following resolution.

Resolved by the Senate and House of Representatives in General Court convened, That Atkinson Webster be, and he hereby is author

ized and empowered to alter and improve the seats in the Representatives' Hall by making the backs of the seats decline two or three inches, the benches forming a right angle; and by providing suitable accommodations to each seat for writing, with a draw and lock thereon'; that each seat be numbered, and that the Speaker's chair, side seats, and Clerks' table, be placed on the west side of the House according to the plan herewith exhibited, providing that the whole expense of making such alterations and improvements does not exceed the sum of five hundred dollars; and that Ralph Metcalf, Abner B. Kelly, and Cyrus Barton, Esquires, be a committee to superintend the same, and that the same be completed during the recess of the present session of the legislature.
